1. Website purpose

This website provides general information about mobile application planning, UI/UX design, iOS development, Android development, cross-platform development, AI feature integration, backend and API integration, testing, store launch support, maintenance and consulting. Website content is informational and is not a binding offer to perform services at a fixed scope, schedule or price.

Displayed prices are starting reference prices in United States dollars unless another basis is expressly stated. A final fee depends on requirements, complexity, dependencies, client responsibilities, timing and acceptance criteria. A service begins only after the applicable commercial terms are accepted.

2. Eligibility and acceptable use

You may use the website only for lawful purposes and in a way that does not damage, disable or interfere with the website or another person’s access. You must not attempt unauthorized access; probe or bypass security controls; introduce malicious code; scrape the website in a manner that imposes unreasonable load; impersonate another person or business; submit false or misleading project information; or use website content to violate intellectual property, privacy or other rights.

3. Project inquiries

An inquiry, consultation request or estimate generated from the website does not create a client relationship, reserve availability or require either party to proceed. We may decline work that is outside available capacity, incompatible with technical requirements, subject to unacceptable compliance risk or otherwise unsuitable.

The website form included in the current package performs browser-side validation, shows a confirmation and clears the fields. It does not itself transmit information. The visitor must use a collection channel configured by the site owner before an inquiry can be received. A confirmation displayed by the unconfigured form is not proof of delivery.

4. Estimates and pricing

Calculator totals and listed service prices are preliminary. They exclude sales or similar taxes, application store fees, third-party licenses, cloud infrastructure, paid datasets, external API usage, travel, hardware and work outside the stated scope unless a written proposal includes those items. Monthly maintenance and hourly consulting are billed on the basis stated in the applicable agreement.

Changes in scope, delayed client decisions, unavailable third-party systems, new compliance requirements or material technical discoveries may require a written change order, revised timing or additional fees. No change is binding until documented in the manner required by the project agreement.

5. Client responsibilities

For a contracted project, the client is generally responsible for providing accurate requirements, timely feedback, authorized content, lawful instructions, test accounts, required access and a decision-maker. The client must have the right to provide all logos, text, data, code, media and third-party materials supplied for use. The client is responsible for business decisions, regulatory classification, end-user terms and privacy disclosures unless the written scope expressly assigns a specific task to Elyqon Mobile.

6. Third-party services

Mobile products commonly depend on application stores, device manufacturers, hosting providers, APIs, analytics, identity systems, payment systems or AI providers. Those services operate under their own terms, pricing, availability and review rules. Elyqon Mobile does not control a third party’s continued operation, approval decision, policy change, outage or security event.

Recommendations are based on the known project requirements at the time. The client remains responsible for accepting third-party terms, maintaining its accounts and paying charges billed directly by those providers unless the written agreement says otherwise.

7. Intellectual property

The website’s original layout, brand materials, photography, text and code are protected by applicable intellectual property law. You may view the website for ordinary informational use, but may not reproduce, sell, publish, remove notices from or create a confusingly similar commercial copy without written permission.

Ownership of project deliverables, reusable tools, pre-existing materials, open-source components and client materials is determined by the applicable service agreement. No project intellectual property transfers merely because an inquiry is submitted or an estimate is discussed.

8. Confidentiality

Do not submit trade secrets, credentials, regulated data or other highly confidential material through a general website interface. Confidentiality obligations for a project should be documented in the relevant agreement. Information already public, independently developed, lawfully received from another source or required to be disclosed by law may be excluded from confidentiality protection as stated in that agreement.

9. Accuracy and availability

Reasonable efforts are made to keep website information clear and current, but errors, outdated references or temporary interruptions may occur. The website is provided on an “as available” basis. To the maximum extent permitted by law, no warranty is made that the website will be uninterrupted, completely error-free or suitable for a particular purpose. This paragraph concerns the public website and does not replace express warranties written into a client agreement.

10. Limitation of liability

To the maximum extent permitted by applicable law, Elyqon Mobile LLC will not be liable for indirect, incidental, special, exemplary or consequential losses arising solely from use of, or inability to use, this public website. Any liability connected with paid professional services is governed by the applicable signed agreement. Nothing in these terms excludes liability that cannot legally be excluded.

11. Indemnity

You are responsible for losses arising from your unlawful misuse of the website, your violation of another person’s rights or materially false information you submit. Any project-specific indemnity must be contained in the applicable written agreement and is not created by these website terms alone.

12. Governing law and disputes

Unless a binding service agreement provides otherwise, these website terms are governed by the laws applicable in the State of Colorado, without regard to conflict-of-law principles. Before filing a formal claim, the parties should attempt in good faith to describe the issue in writing and seek a practical resolution. Mandatory consumer rights and jurisdiction rules remain unaffected where they apply.

13. Changes and severability

These terms may be updated when the website, services or applicable law changes. The updated date identifies the current version. If a provision is found unenforceable, the remaining provisions continue to the extent permitted by law. Failure to enforce a provision once is not a waiver of future enforcement.
